Allgemeine Geschäftsbedingungen – ADRIATICA’s Art

Diese Bedingungen gelten für alle Bestellungen im Online-Shop und für künstlerische Dienstleistungen (Bodypaint, Make-Up, Tattoo) bei ADRIATICA’s Art.


1. Firmendaten / Rechtsform

ADRIATICA’s Art ist in Frankreich registriert als:

  • Micro-entrepreneur (Kunstdrucke, Poster, Merchandising)

  • Artiste-auteur (Originalkunstwerke, Bodypaint, Make-Up, Tattoo)

Umsatzsteuer wird nach französischem Recht angewendet. SIRET-Nummer und TVA werden bei Verfügbarkeit ergänzt.

Alle Rechte an den künstlerischen Arbeiten verbleiben bei ADRIATICA’s Art. Der Kunde erwirbt ausschließlich die vereinbarte Nutzungsart (z. B. Besitz eines Kunstdrucks), nicht das Urheberrecht. Veröffentlichung, Reproduktion oder kommerzielle Nutzung bedarf der ausdrücklichen schriftlichen Zustimmung.


2. Produkte

Der Shop verkauft:

  • Originalkunstwerke

  • Kunstdrucke

  • Auftragsarbeiten

Abweichungen in Farbe, Struktur oder künstlerischer Interpretation stellen keinen Mangel dar. Subjektive Geschmacksunterschiede begründen keinen Anspruch auf Rückerstattung.


3. Terminbuchungen / Dienstleistungen

  • Bodypaint, Make-Up und Tattoo sind künstlerische Dienstleistungen.

  • Mit Buchung eines Termins wird ein verbindlicher Vertrag geschlossen.

  • Termine sind exklusiv für den Kunden reserviert und nicht erstattungsfähig.

  • Stornierungen sind nur aus triftigen Gründen zulässig (z. B. Krankheit, Todesfall). Ersatztermine werden angeboten.

  • Bei verspätetem Erscheinen kann der Termin verkürzt oder abgesagt werden.

  • Der Kunde bestätigt durch die Buchung, dass er gesund ist und keine Allergien oder Hautprobleme hat, die gegen die Leistung sprechen.

 

4. Eigentumsvorbehalt / Urheberrechte

  • Die Ware bleibt bis zur vollständigen Bezahlung Eigentum von ADRIATICA’s Art.

  • Alle künstlerischen Entscheidungen liegen ausschließlich bei der Künstlerin. Sie entscheidet frei über Motiv, Umsetzung auf Haut oder Leinwand.

  • Fotos oder Videos, die während oder nach der künstlerischen Dienstleistung entstehen, dürfen von ADRIATICA’s Art für Portfolio, Website, Social Media, Ausstellungen und Marketingmaterial verwendet werden.

  • Die Zustimmung zur Veröffentlichung ist Vertragsbestandteil und kann nicht widerrufen werden.

  • Bei allen Veröffentlichungen muss der Name der Künstlerin angegeben werden (Artist Credits).

  • Der Kunde hat kein Mitspracherecht über die Auswahl der veröffentlichten Fotos.

 

5. Haftung

  • ADRIATICA’s Art haftet nicht für allergische Reaktionen oder Hautirritationen außerhalb der Kontrolle der Künstlerin.

  • Der Kunde handelt eigenverantwortlich und bestätigt, alle relevanten gesundheitlichen Informationen vor der Leistung offengelegt zu haben.

Terms & Conditions – ADRIATICA’s Art

These terms apply to all purchases in the online shop and for artistic services (Bodypainting, Make-Up, Tattoo) provided by ADRIATICA’s Art.


1. Company / Legal Form

ADRIATICA’s Art is registered in France as:

  • Micro-entrepreneur (art prints, posters, merchandising)

  • Artiste-auteur (original artworks, Bodypaint, Make-Up, Tattoo)

 

VAT is applied according to French law. SIRET and TVA numbers will be added when available.

All rights to artistic works remain with ADRIATICA’s Art. Customers acquire only the agreed usage (e.g., possession of a print), not the copyright. Any reproduction, publication, or commercial use requires written consent.


2. Products

The shop sells:

  • Original artworks

  • Art prints

  • Commissioned works

Variations in color, texture, or artistic interpretation do not constitute defects. Subjective taste differences do not justify refunds.


3. Appointments / Services

  • Bodypainting, Make-Up, and Tattoo are artistic services.

  • Booking an appointment constitutes a binding contract.

  • Appointments are reserved exclusively for the client and are non-refundable.

  • Cancellations are allowed only for valid reasons (e.g., illness, death in the family) with a rescheduled appointment offered.

  • In case of lateness, the appointment may be shortened or canceled.

  • The client confirms they are healthy and have no allergies or skin conditions that prevent the service.

 

4. Ownership & Copyright

  • Goods remain property of ADRIATICA’s Art until fully paid.

  • All artistic decisions are made solely by the artist. She has full discretion over the design, including on skin or canvas.

  • Photos or videos created during or after the artistic service may be used by ADRIATICA’s Art for portfolio, website, social media, exhibitions, and marketing purposes.

  • Consent to publication is part of the contract and cannot be revoked.

  • The artist’s name must be credited for all publications.

  • The client has no say in which photos are published.

 

5. Liability

  • ADRIATICA’s Art is not liable for allergic reactions or skin irritations outside the artist’s control.

  • The client acts responsibly and confirms all relevant health information has been disclosed prior to the service.

Conditions générales de vente – ADRIATICA’s Art

Ces conditions s’appliquent à toutes les commandes en ligne et aux prestations artistiques (Bodypaint, Make-Up, Tattoo) proposées par ADRIATICA’s Art.


1. Société / Statut légal

ADRIATICA’s Art est enregistrée en France comme :

  • Micro-entrepreneur (impressions d’art, posters, merchandising)

  • Artiste-auteur (œuvres originales, Bodypaint, Make-Up, Tattoo)

 

La TVA est appliquée conformément à la législation française. Numéro SIRET et TVA seront ajoutés dès disponibilité.

Tous les droits sur les œuvres artistiques restent la propriété de ADRIATICA’s Art. Le client acquiert uniquement le droit d’usage convenu (par ex., possession d’une impression), pas le droit d’auteur. Toute reproduction, publication ou utilisation commerciale nécessite un accord écrit.


2. Produits

La boutique vend :

  • Œuvres originales

  • Impressions d’art

  • Œuvres sur commande

Les variations de couleur, de texture ou d’interprétation artistique ne constituent pas un défaut. Les différences de goût subjectives ne donnent pas droit à un remboursement.


3. Rendez-vous / Prestations

  • Bodypaint, Make-Up et Tattoo sont des prestations artistiques.

  • La réservation d’un rendez-vous constitue un contrat ferme.

  • Les rendez-vous sont réservés exclusivement au client et ne sont pas remboursables.

  • Les annulations ne sont autorisées que pour des raisons valables (maladie, décès), avec proposition d’un rendez-vous de remplacement.

  • En cas de retard, le rendez-vous peut être écourté ou annulé.

  • Le client confirme qu’il est en bonne santé et qu’il n’a aucune allergie ou condition cutanée empêchant la prestation.


4. Propriété & Droits d’auteur

  • Les biens restent la propriété de ADRIATICA’s Art jusqu’au paiement intégral.

  • Toutes les décisions artistiques sont prises exclusivement par l’artiste. Elle décide librement du motif et de la réalisation sur la peau ou la toile.

  • Les photos ou vidéos réalisées pendant ou après la prestation artistique peuvent être utilisées par ADRIATICA’s Art pour portfolio, site web, réseaux sociaux, expositions et matériel marketing.

  • Le consentement à la publication fait partie du contrat et ne peut être révoqué.

  • Le nom de l’artiste doit être mentionné pour toutes les publications (crédit artistique).

  • Le client n’a aucun droit de regard sur les photos qui seront publiées.


5. Responsabilité

  • ADRIATICA’s Art n’est pas responsable des réactions allergiques ou irritations cutanées hors du contrôle de l’artiste.

  • Le client agit de manière responsable et confirme avoir communiqué toutes les informations médicales pertinentes avant la prestation.
